Internal Fence Requirements

An internal pool fence must be a minimum 1200mm in height.

There can be no gaps greater than 100mm under or between the fence.

Any items for e.g., pots, lights and chairs cannot be within 900mm from the top of the internal fence and within 500mm of the base of the fence as any items decrease the height of your fence and can assist a child climbing into the swimming pool.

Items cannot be within 300mm on the inside of the swimming pool enclosure
Gate Requirements

All gates are to open away from the swimming pool.

The gate must self-close from all positions.

Hinges must be a minimum 900mm apart measured from the top of the bottom hinge to the top of the top hinge.

The latch hight is to be a minimum 1500mm from the ground. On glass panels a minimum 150mm from the top of the fence inside the swimming pool enclosure.
Boundary Fence Height Requirements

If your boundary fence between you and your neighbour forms your pool fence it must be a minimum 1800mm high on your side.

Any items including a pool pump located within 500mm of the base of the fence will affect your boundary height.

The are to be no items or vegetation located within 900mm from the top of the boundary fence.
Windows

Restricting the window opening to a maximum 100mm (note: fasteners used to secure the window opening must be of a type that requires the use of a tool to enable removal and replacement of the fastener) or

Installing a secure metal screen over the window opening and fixed to the outside of the building (note: openings in the screen meshing shall not be greater than 100 mm) or
-
Installing metal bars over the window opening and fixed to the outside of the building. (note: openings between the vertical metal bars shall not be greater than 100 mm).

A compliant swimming pool certificate lasts for 3 Years. A non-compliant swimming pool certificate lasts for 1 year as long as it is actively for sale.
‘Swimming pools and spa pools’ includes in ground, above-ground, indoor, portable and other types of pools and spa pools that are capable of being filled to a depth of 300mm or more of water.
The new laws apply to swimming pools or spa pools associated with: – Private houses, townhouses, units and other strata and community schemes, and moveable dwellings – Hotels, motels and serviced apartments – Backpackers’ accommodation – Homestay, farm stay and bed and breakfast accommodation – Other tourist and visitor accommodation (excluding camping grounds, caravan parks and eco-tourist facilities).
From the 29th April 2016, all properties with a swimming pool or spa pool that are sold must have a valid swimming pool certificate of compliance. This includes any property with a swimming pool or spa pool that is on the market for lease.
